Privacy Notice for Talents, Customers and Suppliers

I. Identification of the person responsible.

In accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the “Law”) and its Regulations, we inform you that C.Mariana Dolores Sahagún Roldán, (hereinafter the “Controller”) , with address at Anguila 3624, Res Loma Bonita, Zapopan Jalisco, will process the personal data that you as Owner provide to us in terms of this Privacy Notice (hereinafter “Notice”).

 

II. Personal Data we collect.

The personal data collected will be treated and protected based on the principles established in the Law and its Regulations, which are: legality, consent, information, quality, purpose, loyalty, proportionality and responsibility. Once you deliver your Personal Data to the Controller, we inform you that these will be kept in different secure media that technology allows, whose access will be limited only to natural and/or legal persons with whom the Controller has some relationship and only for the purposes established in this Privacy Notice.

Talent: To fulfill the purposes mentioned in this Notice, we require that you provide us with the following Personal Data: Full name, address, telephone number (landline and mobile), R.F.C., C.U.R.P., email, nationality, place of residence, copy of official identification, date and place of birth, with the purpose of registering it as a talent of the Sea Melodies Agency in charge of the Responsible, for its promotion in different events and projects. Likewise, photographs and videos will be collected for promotion purposes as talent, all your data will be treated confidentially by the person responsible. At the time of registering and accepting the Privacy Notice, the talent transfers, free of charge, the moral and patrimonial rights of both photographic and video images in favor of the Controller, for the purposes that he requires, among which are: illustrative but not limiting, its publication and dissemination inside and outside the Mexican Republic, without time limit, mainly on the Internet including social networks, the website www.seamelodies.com and any other media. In this order of ideas, the Talent is obliged to subscribe any document that the Controller deems necessary, in order to make use of his or her image through any means of communication known or yet to be known, without this implying any payment for its appearance in any medium and without modifying, altering or incurring crimes against the dignity of the person. The talent data will also be used for contracting purposes in projects, which will be formalized through a contract between the Controller and the talent.

Clients: To register as a client, identify you in any type of legal or business relationship, provide, process, complete and follow up on the services required by you and comply with the obligations contracted, prepare the corresponding invoice that covers the service. provided if requested, for tax declaration purposes and to collect payment for services; Personal Data will be required such as name, R.F.C., billing address, copy of voter ID, telephone number and email, which will be treated confidentially by the Controller.

Suppliers: To register as a supplier, identify you in any type of legal or business relationship, to carry out all necessary internal issues related to the current commercial relationship, including payment issues and to prepare orders, service requests, quotes and any pre-contractual activity, Personal Data will be required such as name, RFC, banking information to make the corresponding payment, telephone number and email, which will be treated confidentially by the Controller.

 

III. Purposes of the processing of your Personal Data.

The Controller collects personal data from him, with the aim of using it for the following purposes:

a) To generate a database of talent, clients and suppliers;

b) Improve the control and implementation of subsequent consultation processes;

c) Provide you with a service;

d) Hire a service;

e) Enter into a contract;

f) Promote talents for shows and/or projects.

 

IV. Means to limit the use or disclosure of your Personal Data.

We inform you that your personal data will be protected under strict administrative, technical and physical security measures which have been implemented, in order to protect and guarantee your personal data against damage, loss, alteration, destruction or use, access or unauthorized treatment.

The processing of your Personal data may be carried out by the Responsible, in accordance with these terms and conditions, so from this moment it is understood that you expressly authorize the Responsible for this purpose, until you express your opposition through any of the means indicated by the Law.

 

V. Means to revoke consent for the processing of your Personal Data.

You may revoke your consent to the processing of your personal data in the same way in which you granted your consent. Likewise, you have the right to: (i) Access your personal data in our possession and know the details of their processing, (ii) Rectify them if they are inaccurate or incomplete, (iii) Cancel them when you consider that they are not required for any of the purposes indicated in this Notice, are being used for non-consensual purposes or the contractual or service relationship has ended, or (iv) Oppose the processing of the same for specific purposes, as provided by Law (hereinafter " ARCO Rights"). To exercise your ARCO Rights, you must submit a Request (hereinafter “ARCO Request”), to the attention of the Privacy Officer, to the Contact Address or to the following email: info@seamelodies.com, accompanied by the following information and documents:

 

  1. Your name, address and email so that we can communicate the response to the ARCO Request;

  2. A copy of the documents that prove your identity (copy of IFE, passport or any other official identification) or, where applicable, the documents that prove your legal representation, the original of which must be presented in order to receive the response from the Controller;

  3. A clear and precise description of the personal data with respect to which you seek to exercise any of the ARCO Rights; which are: Access, Rectification, Cancellation and Opposition.

  4. Any document or information that facilitates the location of your personal data;

  5. If you request rectification of your personal data, you must also indicate the modifications to be made and provide the documentation that supports your request. The Privacy Officer will respond and follow up on your ARCO Rights Request within the deadlines established by Law. Likewise, you may revoke your consent for the processing of your personal data following the same procedure as the one mentioned for the exercise of your rights. ARCO Rights, in which case you will also be renouncing your registration in the Agency with the Controller, whether as talent, client or supplier.

 

To whom can you submit your complaints and complaints regarding the improper processing of your personal data?

If you consider that your right to protection of personal data has been harmed by any conduct on the part of the Controller or you presume that in the processing of your personal data there is a violation of the provisions set forth in the Federal Law on Protection of Personal Data Held by Individuals may file the corresponding complaint or report with the IFAI, for more information visit www.ifai.org.mx.

 

VI. Data transfer

The person responsible will refrain from selling, leasing or renting your Personal Data with a third party, but for operational and service reasons they will be transferred only with companies with which contracts are entered into for the talent to provide their services to the company, the agency being Sea. Melodies, in charge of the Controller, the intermediary link between both.

 

These companies are obliged to maintain the confidentiality of the information provided and not to use it in a manner other than that established in this Privacy Notice. It is understood that you consent to the transfer of your data by accepting this Notice.

 

VII. Age limit.

The person responsible does not admit data of any kind to minors under 18 years of age, reserving the right to request information and services only from adults. As soon as the Controller realizes that a minor has entered data on the website, it will be deleted immediately.

 

VIII. The cookies.

To facilitate the use of our website, we use “cookies”. Cookies are small units of data that your browser stores on your computer's hard drive and are necessary to use our website. IX. Changes or modifications to this Notice.

The Controller reserves the right to make modifications or updates to this Notice at any time, with the understanding that any modification to it will be made known to you by email or through our website www.seamelodies.com.
